The short answer
Taiwan does not regulate container houses with a single law. What decides whether you can put one on a site, and how tall it may be, is the land category (farmland, building land, or a designated zone), whether the unit is treated as fixed or movable, and the local county government’s enforcement practice. The much-searched “5 flat height limit” applies to farm buildings and agricultural structures, not to every container on every plot.
This page covers the rules in English for buyers and contractors outside Taiwan; the Chinese pages go deeper on county-by-county practice.
Where the “5 flat” and height limits come from
Taiwan’s Building Act sets a general maximum of five storeys for buildings that need a construction permit. For agricultural facilities on farmland — the category most container houses fall into when placed on farm land — the rules are stricter and are set by the agricultural authorities plus the county:
| Situation | What applies |
|---|---|
| Container on farmland, used for storage or farm equipment | Treated as an agricultural structure; area and height caps apply, and the structure must be genuinely for farming use |
| Container used as a dwelling on farmland | Not permitted as an agricultural facility; a dwelling needs building land and a permit |
| Container on building land (建地) | Needs a construction permit if it is fixed; must meet setback, coverage and height rules for that zone |
| Container on a construction site, temporary | Usually treated as a temporary structure; still needs the site owner’s consent and may need a temporary permit |
The practical reading: the height limit is rarely the binding constraint — the land category is. A site that allows a container at all usually allows it to the height its zone permits; a site that does not allow it will not be fixed by using a shorter unit.
Fixed or movable: the test that decides permits
Taiwan does not define “container house” in law. Inspectors apply a practical test:
- Connected to permanent utilities (fixed water, power, sewer) → more likely to be treated as fixed
- On a permanent foundation rather than blocks or skids → more likely fixed
- Used as a residence or a business address → more likely fixed
A unit on skids, with a temporary power connection, used as a site office, is normally treated as movable equipment. The same unit on a concrete foundation with a registered address is a building.
Farmland versus building land
Farmland (農地): container use is limited to agricultural purposes. Structures must be for farming, and counties cap both the footprint and the height. Building a dwelling on farmland without approval is one of the most commonly enforced violations, and enforcement is complaint-driven — a neighbour report is usually what triggers a site visit.
Building land (建地): a container used as a fixed structure needs a construction permit (建照) and must comply with the zoning rules for coverage, floor area ratio and height. Some plots also need a location clearance.
Documents an application typically needs
- Land ownership certificate and land registration transcript
- Site plan showing setbacks and the container footprint
- Structural drawings for the unit — we supply these
- Material certificates and panel fire test documents — we supply these
- Utility connection plan (water, power, drainage)
We are a manufacturer, not a licensed Taiwanese architect or a permit agent. We provide the technical documents your local architect or engineer needs; the application itself runs through them.
What this means if you are buying from outside Taiwan
Three practical points:
- Ask about the land before the unit. The same 20ft unit is legal on one plot and a violation 500 m away.
- Get the drawings early. Your architect will need the structural drawings and the panel fire documents before they can file anything, and those come from the factory.
- Plan for enforcement, not just approval. In Taiwan, unpermitted structures are usually discovered by complaint. Budget for the permit process rather than the fine.
